2. Scope and principles

This notice explains which personal data we process when operating this website, for which purposes, and which rights you have. It covers the website at wmsolution.ch, including its German-language version.

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and its ordinance. Where the EU General Data Protection Regulation (GDPR) applies to a processing activity — for example because we offer goods or services to people in the EU — we additionally follow its requirements.

We only process personal data that we need for the stated purposes, process it in good faith, and protect it with appropriate technical and organisational measures.

3. Data processed when you visit this website

When you open this website, your browser transmits technically necessary information to the server of our hosting provider, which may record it in server log files. This typically includes:

• the IP address of the requesting device,
• the date and time of access,
• the name and URL of the file requested,
• the volume of data transferred and whether the request succeeded,
• the referring website, if sent by your browser,
• browser type, browser version and operating system.

This processing serves the technical delivery of the website, operational security, and the prevention and investigation of misuse. It is based on our overriding interest in the secure and stable operation of the website (Art. 31 FADP; where the GDPR applies: Art. 6(1)(f) GDPR).

The website is hosted by cyon GmbH, Brunngässlein 12, 4052 Basel, Switzerland (cyon.ch). The provider processes the data as a processor, solely to deliver the hosting service and on our instructions. The retention period and scope of the log files depend on the hosting provider's configuration; the data is not combined with other data sources. According to the provider, operations run in data centres in Switzerland.

4. Contact form

What we collect

If you use the contact form on this website, we process the details you enter:

• name (required),
• email address (required),
• company (optional),
• the service you selected (photovoltaics, telecommunication, or both),
• your project description in the message field (required),
• your agreement to this privacy notice.

Please do not send sensitive personal data (such as health data) or confidential documents through the form.

Purpose and legal basis

We process these details solely to answer your enquiry and to prepare or perform a possible business relationship. The processing is based on the consent you give by submitting the form, and on taking steps at your request prior to entering into a contract (Art. 6(1)(a) and (b) GDPR, where applicable). Providing the data is voluntary; without the required fields, however, we cannot answer your enquiry.

Web3Forms form service

The form is submitted through the Web3Forms service (web3forms.com). Your entries are sent encrypted to the Web3Forms interface; the service forwards them to our mailbox by email and acts as a processor. In addition to the form content, technical connection data such as your IP address may be processed by the provider for delivery and spam prevention. Details of the provider's processing are set out in its privacy policy at web3forms.com/privacy. Processing on servers outside Switzerland and the EEA cannot be ruled out; see section 9.

If you prefer not to use this service, you can always contact us directly by email or phone using the contacts in section 1.

Spam protection

The form contains a check field that is invisible to you (a honeypot field) to detect automated submissions. It collects no additional personal data about you and sets no cookies. No captcha service is used.

5. Contact by email and telephone

If you contact us by email or telephone, we process your contact details and the content of your message in order to deal with your request. The legal basis is the performance of pre-contractual or contractual measures, or our legitimate interest in responding to enquiries. Unencrypted email travels across the open internet, so complete confidentiality cannot be guaranteed for it.

6. Cookies, tracking and external content

This website sets no cookies that require consent. No analytics, advertising or tracking services are used and no usage profiles are created. The website embeds no external fonts, maps, videos or social media plugins; all images, stylesheets and scripts are served from our own server. Your browser only handles the technically necessary data that arises when any website is requested.

No data is passed to third parties beyond the services named in this notice (hosting, form service).

7. Links to third-party websites

The website links to the official websites of customers and partners, and to a map service showing our location. These links are only called up when you click them. Once you follow such a link, the privacy terms of the respective provider apply. We have no influence over their content or data processing and accept no responsibility for it.

8. Retention and deletion

We keep personal data for as long as it is needed for the purposes described in this notice. Enquiries sent through the contact form and the related correspondence are kept for as long as handling your request requires, and for as long as statutory retention obligations — in particular under commercial and tax law — or the establishment of legal claims require. After that, the data is deleted or anonymised.

9. Disclosure abroad

In connection with the services described above, we may disclose personal data to processors abroad. If data is disclosed to a country without an adequate level of data protection, we ensure appropriate protection by the means provided for by law — in particular standard contractual clauses, or the clauses recognised by the Swiss Federal Data Protection and Information Commissioner (FDPIC) — or we rely on a statutory exception such as your express consent or the necessity of performing a contract.

10. Data security

The website is delivered over an encrypted HTTPS connection, and the contact form is likewise submitted encrypted. We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. Absolute security of data transmission over the internet cannot be guaranteed by anyone.

11. Your rights

Within the limits of applicable law, you have the following rights in relation to us:

• access to the personal data we process about you,
• rectification of inaccurate data,
• erasure or destruction of data,
• restriction of processing and objection to processing,
• release or transfer of your data in a common electronic format,
• withdrawal of consent with effect for the future; the lawfulness of processing carried out before withdrawal is unaffected.

To exercise these rights, a message to the address in section 1 is sufficient. We may request additional information to verify your identity. Data processed for that verification is not used for any other purpose.

You also have the right to lodge a complaint with a supervisory authority. In Switzerland this is the Federal Data Protection and Information Commissioner (FDPIC), edoeb.admin.ch. Where the GDPR applies, you may contact the supervisory authority of your place of residence or work.

12. Changes to this notice

We may adapt this privacy notice when our processing, the services we use, or legal requirements change. The version published on this page, with the date shown above, is the one that applies.
